These terms govern your use of sparecarpart.com (the "Service"). By creating an account or requesting a quote, you agree to them. Please read carefully - section 4 (our role) and section 7 (liability) are important.
1. Who we are
SpareCarPart is the trading name used for the Service. References to "we", "us" and "our" mean the operator of SpareCarPart. References to "you" mean any visitor, registered user, or supplier using the Service. Contact us at support@sparecarpart.com with any question about these terms.
2. Accounts
You must be at least 18 to open an account. You are responsible for keeping your password secure and for all activity on your account. Notify us immediately at support@sparecarpart.com if you suspect unauthorised use.
3. The marketplace
SpareCarPart is an online marketplace. We let you describe a part you need; independent breaker yards and parts suppliers ("Suppliers") then send you quotes. You decide whether to accept a quote and buy directly from the Supplier.
4. Our role: introducer only
SpareCarPart is not the seller of any part listed on the Service. Each contract for the supply of parts is formed directly between you and the Supplier. We are not a party to that contract, we do not take possession of the goods, and we are not responsible for the description, condition, fitment, delivery, or after-sales service of any part.
We carry out reasonable checks on Suppliers before they are admitted to the network, but we cannot guarantee the conduct of any individual Supplier. If a Supplier breaches our standards or these terms, we will cancel their subscription and remove them from the network.
5. Buyer protection & complaints
Although we are not the seller, we want every transaction on our network to go well. If something goes wrong, we will help you:
- Open a complaint against the Supplier on your behalf.
- Pass your complaint to the Supplier and ask it to address the written quote terms.
- Suspend or remove a Supplier from the network if they repeatedly fail to resolve complaints.
- Where a Supplier refuses to refund a faulty part covered by the warranty, escalate the dispute and use our supplier hold-back funds, where available, to support a refund.
Our support is goodwill assistance and does not make SpareCarPart liable for the Supplier's obligations under your purchase contract.
6. Supplier terms and statutory rights
Warranty terms, if offered, are set by the supplying business and should be shown in its written quote. Those additional terms do not replace statutory rights that apply to the purchase. Different rules may apply to consumer, trade and private purchases.
7. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Subject to that, SpareCarPart is not liable to you for:
- Any contract you enter into with a Supplier, including non-delivery, faulty parts, fitment issues, vehicle damage, or consequential loss.
- Any indirect, special or consequential loss, loss of profit, loss of business or loss of data.
- Issues caused by inaccurate information you provided (e.g. wrong registration or part description).
Where we are found liable to you, our total liability for any claim is limited to the greater of (a) £100 or (b) the total fees paid by you to SpareCarPart in the 12 months before the claim arose.
8. Acceptable use
You agree not to use the Service to: post false vehicle or part information; harass Suppliers or staff; scrape or copy listings; attempt to circumvent payments; or breach any applicable UK law.
9. Suspending or closing your account
We may suspend or close your account if you breach these terms or use the Service in a way that is harmful or unlawful. You can close your account at any time from your account settings.
10. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except that consumers may also bring proceedings in their country of residence.
